At the start of each rental, the Owner is responsible for keeping the boat fuel tank full or at the maximum capacity allowed by the boat’s marina or the maximum capacity recommended by the manufacturer.
Unless otherwise specified by the Owner in the Boat Features section, Renters must return the Boat with the same amount of fuel in the tank as there was at the start of the rental.

As per Fee and Commission Policies and Procedures, in the event a citation is issued due to an administrative event (‘Event’) associated with law regulation violations, such as processing parking or a speeding ticket, and while taking place during the rental, the party responsible will be liable for the cost.

For every rental, the Renter will be charged a nominal Service Fee as outlined in the Sailo Fee and Commission Policy and Procedures.

Only the authorized Renter can hire a Captain to operate the Boat.

Named Wind Storms

As declared by the National Hurricane Center, when the vessel is within the National Hurricane Center 1-3 day ‘track forecast cone’ for named or numbered storms, all reservations must be cancelled and boats returned.

Documentation of Pre-existing Damage

Documentation of Pre-existing Damage


Before having the Boat operated by a hired Captain, Renters have the option of submitting electronic photographs of any pre-existing damage as permitted by the Service to Sailo Support at support@sailo.com. Photos must be time stamped prior to the beginning of the rental. At the discretion of Sailo, Renters may be liable for any damage they fail to document before accepting the vessel and having it operated by a hired Captain.

Towing

Towing


Through a third party vendor, Sailo may provide vessel assistance for accidents and breakdowns that occur during a rental. These services are not guaranteed and are solely based on availability. However, if the Renter, or a delegate on his behalf, is negligent in any such way resulting in or contributing to the breakdown, it is the Renter's sole responsibility to arrange for and cover the expenses associated with towing the Boat.

Drugs and Alcohol

Drugs and Alcohol


The Renter will not use or transport illegal materials or drugs on or inside the Boat at any time. The Renter must at all times comply with all laws and regulations in respect to the use and operation of the boat. In addition, the Captain, on his/her own as well as the behalf of the hiring Renter, may not operate the Boat while under the influence of alcohol, any prescription or non-prescription drug for which driving during use is not recommended on the label, or by reasonable opinion of a pharmacist or a doctor. In an instance whereby Renter or the Captain may notice any type of on board irregularity associated with the use of drugs and/or alcohol, he/she is required to advise Sailo of any such irregularities.

Negligent or Abnormal Operation


The Renter is prohibited from using the Boat for any negligent use, especially where the intent is abusive or abnormal for its operation.

Personal Floatation Devices

Personal Floatation Devices


As recommended by Sailo, every person in the Boat or on a dock should wear a personal flotation device at all times. In addition, Renters must follow all personal flotation laws while in rented Boats.

Maintenance and Repairs

Maintenance and Repairs


Unlike the Owner, the Renter is not responsible for routine maintenance and repairs of the Boat. The Renter may be held partially liable for the repair cost if the Captain, piloting the boat on behalf of the hiring Renter during the rental, commits damage associated with either accident or negligence. The Renter must follow through with the reporting, claims processing and repair procedures set forth herein for all such damages.

Driving Record

Driving Record


If the Captain, on behalf of the hiring Renter, incurs any incident or violation that affects the Captain's service eligibility, as described in the Captain’s Eligibility Policy and Procedures, that Captain shall become immediately ineligible and must indemnify Sailo, the respective Boat Owner, as well as the Renter for any and all loses that might occur as a result of that Captain's operation of the Boat.

Conditions

Conditions


The Captain, operating on behalf of the hiring Renter, is responsible for understanding local conditions that effect safe boating such as, but not limited to the weather, currents, tides and other local conditions and customs.

Clean Boat

Clean Boat


Boats are to be returned clean and in the same condition as the one in which they were when the Renter took them out. Failure to comply will results in fee as outlined in the Sailo Fee and Commission Policy and Procedures.

No Sublease

No Sublease


In no event shall the Renter sub-lease the boat to another person or entity. Renter’s rights under this agreement are non-transferable.

The Renter may not carry out a crime or participate in any other illegal activity while on board of a Boat.

Reasonable Care and Activities

Reasonable Care and Activities


Renters must not use the boat for high-risk activities and/or must not engage in competitive boating or racing, carrying passengers in areas of the boat other than in the areas designated for passengers, not wearing personal floatation devices when required by law, carrying passengers or anything else in excess of the capacity of the Boat, using the Boat to push, propel or tow another boat, or for illegal and/or dangerous activities. Captains, on behalf of the Renters, must drive and dock the Boat with reasonable care, keep and return the Boat clean, and return it on time. Renters must at all times comply with all laws and regulations relative to the use and the operation of the Boat.
