Sailo will make Captains available for Renters and Boat Owners. Through the Sailo Service, a Captain on board is mandatory, whereby the Renter should choose from the listed Captains for the boat the Renter is interested in renting. If the Renter has preference for one Captain over another, he/she should make sure that the preferred Captain has been registered for approval for the desired boat on the Sailo website. The Captain will be the contracting employee of the Renter and as such agrees to the terms and conditions of the Captain Policies and Procedures. All Captains operating a Boat must be approved by the Boat Owner.

Term and Duties of the work to be performed


Renter agrees to hire the Captain to perform duties for the Renter according to the Terms and Conditions set forth in this policy and in line with the Sailo Owner and Renter Policies and Procedures. Such Captain duties (“Duties”) include, but are not limited to, duties requiring the Captain to:

Perform rental safety and Boat condition inspections before and after the rental by conducting a check-in/check-out Sailo Survey, and make sure he/she logs all the relevant details;

Promptly report any Boat or other condition deficiencies to the Boat Owner, the Renter and Sailo especially if these jeopardize safety of passengers and crew and are detrimental in terms of property damage control;

Pilot and maintain control of the Boat within the Sailo approved geographic area for the renting passengers;

Generally take reasonable actions to protect and preserve the safety of persons and property;

Clean and refuel the Boat as designated by Sailo upon completion of the rental;

Perform duties as reasonably requested by the Renter;

Perform duties in line with the following guidelines relative to dates and times of service: the work to be performed shall commence one hour prior to the scheduled rental and upon the completion of the post-rental inspection unless otherwise indicated by Sailo.

Captain Qualifications and Credentials

Captain Qualifications and Credentials


In order to perform the duties of a Captain on a designated Boat, the Captain needs to attest he/she has proper qualifications, credentials and licensing. In addition, by entering any form of agreement (“Agreement”) facilitated through Sailo and the use of Sailo Site, Captain represents that he/she is free to enter into such Agreement and that such engagement does not violate any local, state, provincial, national, maritime or other law or regulation, as well as the terms of any other agreement that the Captain may have with any third party. Moreover, during the duration of the service agreement, Captain agrees to commit to devoting as much productive time, energy and abilities as deemed needed and necessary to perform the required duties in a timely and productive manner.

Insurance

Insurance


Sailo generally does not provide insurance for the Captains, but it certainly encourages its Captains to have their own insurance in case of any potential disputes associated with personal negligence.

Employment Status

Employment Status


Captain acknowledges that he/she is an independent contractor and is not an agent, partner, joint venture associate or an official employee of Sailo, the Boat Owner or the Renter of the Boat. Captain shall have no authority to bind or otherwise oblige Sailo or Boat Owner in any manner nor shall he/she falsely represent to anyone that he/she has a right to do so.

Compensation and Withholding

Compensation and Withholding


In consideration of all services to be rendered by Captain to the Renter, Sailo shall collect Captain compensation from the Renter and pay the Captain a sum equal to the amount agreed on Captain’s profile page less a Service Fee including, but not limited to a booking fee, credit card transaction fees and charge backs. Such compensation shall be paid upon collection of funds from the Renter and full completion of the rental. Since Captain is an independent contractor, he/she shall be responsible for his/her own income taxes, worker’s compensation and other employment taxes.
