Extenuating Circumstances


The cancellation policy rules and fees can be superseded by Sailo if certain extenuating circumstances can be shown.

Both Renter and the Boat Owner are able to cancel the Service by contacting support@sailo.com and providing appropriate documentation to support the cancellation.

In line with that, the Renter shall receive a 100% refund and the Boat Owner and Captain will not receive payment for the following extenuating circumstances:

Reservation location of the reserved Boat is within the National Hurricane Center 150 miles cone of probability of named or numbered storms;

Safety related cancellations originating from, but not limited to, adverse weather conditions and apparent prior to the beginning of the rental. Such conditions include, but are not limited to the event of lightning, thunderstorms, heavy rain, or heavy wind within eight (8) hours of the time of scheduled rental;

Natural disaster in general;

Political Unrest;

Death in the family;

An issue with the Boat considered to be the responsibility of the Owner that causes the rental to end prematurely;

Boat Owner cancellation or no access to the boat. In this case, the Boat Owner may be subject to penalties;

Captain cancellation, no-show of the Captain or no access to the boat. The Captain may be subject to penalties;

An issue with the rental determined to be the responsibility/or caused by the negligence of the Boat Owner that causes the Renter to end the said rental. In this case, the Boat Owner may be subject to penalties;

Listing inaccuracies. If the description of the Boat in the listing on the Site is materially or otherwise inaccurate with respect to:

the physical location of the Boat (i.e. vicinity)

the size of the Boat (e.g, relative but not limited to seating capacity in terms of both the size and number, make and/or model);

the fact that another party, including the Boat Owner, may be using the Boat during the reservation time;

the fact that special features represented in the listing description may not be provided and/or do not function, such as engines, water, lights, bathrooms (toilet/shower/bathtub), kitchen (sink/stove/refrigerator or other major appliances), and electrical, wi-fi, heating or air condition systems.
